These Terms & Conditions explain the rules for using our website and purchasing products from us.
Evermont Wellness is a trading name of Evermont Commerce Ltd, a company registered in the United Kingdom.
By using our website or placing an order with us, you agree to these Terms & Conditions. Please read them carefully before using our website or purchasing from us.
Nothing in these Terms & Conditions affects your statutory rights as a consumer under UK law.

Throughout these Terms & Conditions, “Evermont Wellness”, “Evermont”, “we”, “us” and “our” refer to Evermont Commerce Ltd trading as Evermont Wellness.

You may use our website for lawful purposes only.

We aim to provide accurate and up-to-date information about all products available through Evermont Wellness.
Product images are provided for illustrative purposes. Actual colours, finishes and appearance may vary slightly depending on your device, screen settings, lighting and the manufacturer's production process.
Product specifications, dimensions, colours, features and availability may change where necessary, particularly where products are supplied or manufactured by third-party suppliers.
Where a product specification changes after you have placed an order, we will not knowingly provide a materially different product without contacting you where required.
We reserve the right to discontinue products or change product availability at any time.

4. Product safety and use
Certain Evermont Wellness products are specialist wellness, recovery, fitness or electrical products.
You are responsible for reading and following the manufacturer's instructions, safety information and installation requirements supplied with your product.
Where applicable, you should ensure that:

- Any required electrical, plumbing or structural requirements are met
- The product is used only for its intended purpose
- Safety instructions and warnings are followed

These provisions do not limit any statutory rights you may have in relation to defective or unsafe products.
5. Prices
All prices displayed on our website are shown in British pounds (£) unless otherwise stated.
Evermont Commerce Ltd is not currently VAT registered, and VAT is therefore not charged separately on our products.
Any delivery charges or other additional charges applicable to your order will be shown before you complete your purchase.
Prices may change from time to time. However, changes will not affect an order that we have already accepted, except where an obvious pricing error has occurred.
Promotional offers may be subject to additional terms, which will be displayed alongside the relevant promotion.
6. Placing an order
When you place an order through our website, you are making an offer to purchase the products selected at the price displayed at the time of purchase.
After you submit your order, we will normally send an acknowledgement confirming that we have received it.
This acknowledgement does not necessarily mean that your order has been accepted.
Your order will be accepted when we send you confirmation that the order has been accepted or otherwise confirm that the products have been dispatched, unless we notify you that your order has been rejected or cancelled.
We may decline or cancel an order before acceptance where, for example:
- A product is unavailable
- There is an obvious pricing or product-description error
- We are unable to fulfil the order
- We suspect fraudulent or unauthorised activity
- Delivery to the requested location is not available
- We are unable to obtain the product from the relevant supplier
If we cancel an order after payment has been taken, we will arrange an appropriate refund.

Please check your order carefully before submitting it.
You are responsible for providing accurate information, including your name, delivery address, email address and telephone number.
If you discover an error in your order information, please contact us as soon as possible.
We will make reasonable efforts to correct information where possible, but we cannot guarantee that changes can be made after an order has been accepted or dispatched.

Payment must be made using one of the payment methods available at checkout.
Payment information is processed through Shopify and/or relevant third-party payment providers.
We do not normally store your full payment card details.
You confirm that you are authorised to use the payment method provided.
If payment cannot be authorised or is subsequently reversed or declined, we may be unable to fulfil the order.
9. Delivery
We currently deliver products to customers within the United Kingdom.
Delivery arrangements may vary depending on the product, delivery location, supplier and delivery method available for your order.
Any applicable delivery charges and available delivery information will be shown during the purchasing process or communicated to you where appropriate.
Delivery timeframes provided on our website or in communications are estimates unless we expressly state otherwise. We will make reasonable efforts to ensure your order is delivered within the timeframe communicated to you.
Some large, heavy or specialist products may require specialist delivery arrangements. Where this applies, we may contact you to arrange a suitable delivery method or date.
If there is an unexpected delay with your order, we will make reasonable efforts to keep you informed.
We are not responsible for delays caused by circumstances outside our reasonable control, although this does not affect your statutory rights where delivery obligations have not been met.
For consumer purchases, responsibility for the goods remains with us until the goods come into your physical possession or the possession of a person you have identified to receive them, unless you have independently arranged a carrier not offered by us.
10. Returns, cancellations and refunds

You may have a statutory right to cancel an online purchase within 14 days of receiving the goods, subject to applicable exceptions.

11. Faulty, damaged or incorrect products
If your product is faulty, damaged, incomplete or different from the product you ordered, please contact us as soon as reasonably possible.
We may ask you to provide photographs, videos or other information to help us assess the issue.
Depending on the circumstances and your statutory rights, we may arrange:

- A replacement
- Collection
- A price reduction
- A refund
- Another appropriate remedy
Your rights under the Consumer Rights Act 2015 are not affected by these Terms & Conditions.
12. Manufacturer warranties
Some products may include a manufacturer's warranty.
Where a manufacturer's warranty applies, details will be provided with the product or in the relevant product information where available.
A manufacturer's warranty is additional to, and does not replace or reduce, your statutory consumer rights.
Where appropriate, we may assist you in contacting the manufacturer or relevant supplier regarding a warranty claim.

- Photography

is owned by or licensed to Evermont Commerce Ltd, Evermont Wellness or the relevant third-party rights holder and is protected by applicable intellectual property laws.
You may view and use our website for your personal, non-commercial purposes.
You must not reproduce, copy, modify, distribute, publish, sell or commercially exploit our website content without our prior written permission.
Evermont Wellness and associated branding may not be used without our prior written permission.

We will not falsely represent a review as being from a genuine customer or knowingly publish fabricated reviews.

Our online store is powered by Shopify, which provides the ecommerce platform used to operate our website and process transactions.
Purchases made through our website are transactions between you and Evermont Commerce Ltd trading as Evermont Wellness.
Shopify is not the seller of the products purchased from Evermont Wellness and is not responsible for the products we sell or our contractual obligations to you.

We aim to keep our website available and operating properly, but we cannot guarantee that it will always be available, uninterrupted or error-free.

We will not be responsible for delays or failure to perform our obligations where this results from circumstances outside our reasonable control.
